Abstract
The life and the death of every person are two limits that outsiders only approach, because everybody lives his own life and goes through his own death. The intervention of other people can either help or harm the person. That is why the biological, social, and spiritual-psychological knowledge of each individual has to go together. The problems of practical medicine appear in a certain social and intellectual context of values, yet not always in he human one. The object of medicine, like that of any other science, is not first-hand, but composite. From the viewpoint of values if one subdivides a person, he can easily become only a biological, social, psychological, cultural, legal, material, spiritual or some other part separated from the common context of the person. World outlook is also included. An one-sided and subjective approach to a person will never bring well-being to the person, because he is a social being always integrating into society and thus creating a mutual connection. Medicine is also not omnipotent, but subject not only to its limitations, but also to errors. If one turns medicine into a field only adapting scientific technologies, it can painfully affect the one for whom it is being developed, i.e. man. Medicine can not be left to itself. As any other institution, it must be limited by legal, ethical, and moral norms. Thus, it is understandable why all fundamental and practical scientific fields have to develop together, looking for answers to the existential questions of man. The right to die and the limitation of testament warrants is one of the points of view showing the complexity of the individual. In offering him a “good” death, we can not take away from him the right to live, to appropriate his “will” and, acknowledging his freedom, give him impossible rights and services.
Kiekvieno žmogaus gyvenimas ir mirtis – tai dvi ribos, iki kurių mes, pašaliečiai, tik prieiname, nes kiekvienas gyvename savo gyvenimą ir kiekvienas išgyvename savo mirtį. Įsikišimas kitų arba padeda, arba pakenkia žmogui. Dėl to žmogaus biologinis, socialinis ir dvasinis-psichologinis pažinimas turi eiti kartu. Praktinių medicinos problemų atsiranda tam tikrame vertybiniame socialiniame ir intelektiniame, tačiau ne visada su žmogumi susijusiame kontekste. Medicinos, kaip ir kiekvieno mokslo, objektas nėra tiesioginis, jis yra kompleksiškas. Vertybiniu požiūriu dalijant žmogų jis nesunkiai gali tapti tik biologine, socialine, psichologine, kultūrine, teisine, materialine, dvasine ar dar kokia nors dalimi, nesusijusia su visu žmogaus kontekstu. Pasaulėžiūrinis požiūris irgi nelieka nuošalyje. Viena prasme tikslingas ir subjektyvus požiūris į žmogų niekad nesukurs žmogaus gerovės, nes žmogus yra socialinė vientisa visuomenės dalis, kurianti įvairius tarpusavio ryšius. Medicina taip pat nėra visagalė, kartais jai būdingas ne tik ribotumas, bet ir klaidos. Pavertus ją vien mokslinių technologijų taikymo sfera, ji gali skausmingai atsiliepti tam, dėl ko yra plėtojama, t.y. žmogui. Medicina negali būti palikta savieigai, ją privalo saistyti, kaip ir visas kitas institucijas, teisinės, etinės ir moralinės normos. Todėl visiškai suprantama, kodėl visos fundamentaliosios, praktinės mokslo sritys turi būti tolygiai plėtojamos ieškant atsakymų į egzistencinius žmogaus klausimus. Teisė numirti ir testamentinis įgaliojimų ribotumas – tai vienas iš požiūrių, parodantis individo sudėtingumą – jam siūlydami „gerą“ mirtį, negalime atimti iš jo teisės gyventi, pasisavinti jo valios ir, pripažindami jam laisvę, suteikti negalimų teisių ir patarnavimų.
